1. Parties & Acknowledgment
This End-User License Agreement ("EULA") is a legal agreement between you ("End-User") and the developer of Social Battery ("we," "us," "our"), not with Apple Inc. We, not Apple, are solely responsible for Social Battery and its content. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to Social Battery.
By downloading or using Social Battery, you agree to be bound by this EULA. If you do not agree, do not download or use the app.
2. License
Subject to your compliance with this EULA and Apple's Media Services Terms and Conditions (including the Usage Rules), we grant you a limited, non-exclusive, non-transferable license to use Social Battery on any Apple-branded device that you own or control, solely for your personal, non-commercial purposes.
3. Subscriptions
Social Battery offers optional premium subscriptions ("Social Battery Pro"):
- Subscriptions are billed through your Apple ID at the price displayed at purchase
- A free trial may be offered; trial converts to a paid subscription unless cancelled before the trial ends
- Subscriptions auto-renew unless cancelled at least 24 hours before the current period ends
- Manage or cancel your subscription in iOS Settings → Your Name → Subscriptions
- Deleting app data does not cancel an active Apple subscription
- No refunds are provided for unused portions of a subscription period, except where required by applicable law
4. Prohibited Uses
You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app
- Use the app for any unlawful purpose or in violation of any applicable regulation
- Attempt to bypass, circumvent, or disable any premium features or subscription gates
- Redistribute, sublicense, sell, rent, or otherwise transfer the app or any rights therein
- Remove, alter, or obscure any proprietary notices on the app
5. Maintenance & Support
We are solely responsible for providing maintenance and support services for Social Battery, as required by applicable law and as described in this EULA. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to Social Battery.
6. Warranty
The app is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted or error-free operation.
In the event of any failure of Social Battery to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price you paid for the app (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Social Battery. Any other claims, losses, liabilities, damages, costs, or expenses arising from a warranty failure are our sole responsibility.
7. Product Claims
We, not Apple, are responsible for addressing any claims by you or any third party relating to Social Battery or your use of it, including:
- Product liability claims
- Any claim that the app fails to conform to any applicable legal or regulatory requirement
- Claims arising under consumer protection, privacy, or similar legislation
8. Intellectual Property
All content, design, code, and assets in Social Battery are owned by us and protected by applicable intellectual property laws. The app name, mascot characters, and visual design may not be used without our prior written permission.
In the event of any third-party claim that Social Battery or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
9. Legal Compliance & Export
By downloading or using Social Battery, you represent and warrant that:
- You are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country
- You are not listed on any U.S. Government list of prohibited or restricted parties
- You will use the app in compliance with all applicable local, national, and international laws and regulations
10. Third-Party Terms
Social Battery integrates third-party services including PostHog (analytics), Supabase (data storage), and RevenueCat (subscription management). By using Social Battery, you acknowledge that you must comply with any applicable third-party terms of service when using the app.
11. Apple as Third-Party Beneficiary
You acknowledge and agree that Apple Inc. and its subsidiaries are third-party beneficiaries of this EULA, and that upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
12. Health Disclaimer
Social Battery is a wellness tracking tool for personal use only. It is not a medical device, does not provide medical advice, and should not be used as a substitute for professional medical or mental health care. If you are experiencing a mental health crisis, please contact a qualified professional or your local emergency services.
13. Limitation of Liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the app, even if we have been advised of the possibility of such damages.
14. Governing Law
This EULA is governed by the laws of France and, where applicable, the laws of the European Union, without regard to conflict of law principles. Notwithstanding the foregoing, if you are a consumer resident in the European Union, you also benefit from the mandatory consumer protection provisions of the law of your country of residence. Nothing in this EULA affects your rights as a consumer to rely on such mandatory local law provisions.
Any dispute arising from or relating to this EULA that cannot be resolved amicably may be brought before the competent courts of France, or, for EU consumers, before the competent courts of your country of habitual residence, as permitted by EU Regulation 1215/2012.
15. Changes
We may update these terms at any time. Continued use of Social Battery after changes constitutes your acceptance of the updated terms. We will communicate material changes through the app or our website and update the "Last updated" date above.
